Class Action Lawsuit
Doc B’s Fresh Kitchen Bartenders & Servers
If you worked as a bartender or server at a Doc B’s Fresh Kitchen location, also operating as “Doc B’s Restaurant + Bar”, in the last three years, you may have been underpaid in violation of federal wage laws. We are investigating claims that Doc B’s failed to provide proper tip credit notice, required tipped employees to spend excessive time on non-tip-producing side work while still paying the reduced tip-credit wage, and included non-tip-eligible staff in mandatory tip pools.

A tip credit notice is an explanation your employer is required to give you if they plan to pay you less than the full minimum wage by counting your tips toward that wage. Before using the tip credit, your employer must tell you the cash wage they will pay per hour, the amount of tip credit they will claim, that the tip credit does not apply unless you keep all your tips apart from a valid tip pool, and that it cannot be taken unless they have informed you of these rights.
You would normally receive it when you were hired, either in writing or verbally. If you are unsure whether you received it, give us a call and we will investigate.
Anyone who worked as a bartender, server, or other tipped position at a Doc B’s location in the last three years, did not receive proper tip credit notice, or was required to share tips with non-tipped positions.
