What Is a Tip Credit Notice
A tip credit notice is an explanation your employer is required to give you if they plan to pay you less than the full minimum wage by counting your tips toward that wage. The law requires that before using the tip credit, your employer must tell you:
- The amount of cash wage they will pay you per hour
- The amount of the tip credit they will claim toward meeting the minimum wage
- That the tip credit will not apply unless you keep all your tips (except for a valid tip pool)
- That the tip credit will not be taken unless the employer has informed you of these rights
You would normally receive this notice when you were hired, either in writing or verbally. If you are unsure if you received this notice, give us a call and we will investigate.
