The National Institute for Workers’ Rights (NIWR) received a cy pres award of nearly $30,000 from a class action settlement our firm helped secure for hourly workers. The money came from settlement checks that workers did not cash, and it will now support NIWR’s work for workers’ rights.

The case is Weaver, et al. v. Hyundai Transys Georgia Seating System, LLC. Jordan Richards of USA Employment Lawyers and David Fish of Workplace Law Partners served as plaintiffs’ counsel and named NIWR as the cy pres beneficiary.

What is a cy pres award?

When a class action settles, each worker gets a check. Some checks never get cashed. A worker may have moved, changed jobs or missed the mail.

A cy pres award sends that leftover money to a charity whose work connects to the purpose of the lawsuit. The court must approve the recipient. That way the money still benefits workers instead of going back to the employer.

In this case, NIWR was designated to receive the money from checks left uncashed after 180 days.

Why we chose NIWR

NIWR is the charitable advocacy organization connected to the National Employment Lawyers Association (NELA). It supports workers’ rights through research, education and advocacy for policymakers, advocates, workers and the public. Its focus is removing the barriers that keep workers from getting justice.

Thank you to NELA for recognizing this case, to co-counsel David Fish of Workplace Law Partners, PC, and to NIWR for the work they do for workers every day.
