What the Lawsuit Alleges

The lawsuit claims that The Getaway:
• Required servers to share tips with managers or supervisors
• Took a tip credit toward minimum wage without providing the required notice
• Paid some employees less than the full Florida minimum wage

The case seeks recovery of unpaid wages, misappropriated tips, liquidated (double) damages, and attorney’s fees under the Fair Labor Standards Act (FLSA) and the Florida Minimum Wage Act (FMWA).

Servers and other tipped employees are entitled to keep all of their tips, except for valid tip pools among other tipped staff. Employers cannot include managers or supervisors in a tip pool.
If you were paid a reduced tipped wage without proper written notice or if management participated in your tip pool, you may be entitled to recover the difference up to the full minimum wage for each affected hour, plus double damages.
